Common Questions

Get answers to common questions about Georgia employment law, your rights in the workplace, and what to expect when pursuing a claim.

Georgia is an at-will employment state, which means employers can generally fire employees for any reason — unless that reason is illegal. You are protected if you were terminated due to discrimination (race, gender, age, disability, religion, etc.), in retaliation for reporting illegal activity or exercising your legal rights, in violation of an employment contract, or for reasons that violate public policy. Our attorneys can evaluate whether your termination was unlawful.

Deadlines vary depending on the type of claim. Discrimination claims must be filed with the EEOC within 180 days (extended to 300 days in some cases). Wage and hour claims under FLSA generally have a 2-year statute of limitations (3 years for willful violations). Breach of contract claims have 6 years. These deadlines are strict — missing them can mean losing your right to pursue a claim entirely. Contact us promptly to preserve your rights.

Depending on the nature of your claim, you may be entitled to back pay and front pay, compensatory damages for emotional distress, punitive damages in cases of egregious employer conduct, liquidated damages (double back pay) for willful FLSA violations, attorney's fees and court costs, and reinstatement to your former position. Our team works with damages experts to ensure no category of recovery is overlooked.

Most employment law cases at Brenn Law are handled on a contingency fee basis — you pay nothing upfront, and our fees are taken only as a percentage of the recovery. For contract reviews and severance negotiations, we offer flat fee arrangements so you know exactly what to expect. Your initial consultation is always free and confidential, with no obligation to move forward.

First, document everything — keep a detailed record of incidents, including dates, times, witnesses, and any communications. Save relevant emails, performance reviews, and personnel files. Report the conduct through your employer's internal complaint process if one exists. Do not resign without consulting an attorney first. And most importantly, contact Brenn Law immediately — we'll advise you on how to protect your rights while preserving your legal options.
